General Rental Terms

1.1 These General Rental Terms apply to all offers, rental requests, bookings, and rental agreements of ToolThuis (ToolThuis, KvK: 42176630).

1.2 "Renter" refers to the natural person (consumer) or legal entity that enters into or intends to enter into an agreement with ToolThuis.

1.3 "Tool" or "Rental Kit" refers to the machines, tools, accessories, and components provided by ToolThuis as specified in the order confirmation.

2.1 Submitting an inquiry via www.toolthuis.nl is at all times non-binding. It does not constitute a purchase obligation.

2.2 Upon receipt of your inquiry, ToolThuis verifies machine availability and schedule. Upon approval, the renter receives a personal confirmation link.

2.3 The rental contract is finalized when the renter accepts these terms and completes payment (including deposit) via iDEAL within the 12-hour window. The tool is held temporarily during this 12-hour confirmation window.

3.1 All stated rental prices on the website include 21% Dutch VAT.

3.2 When confirming the booking, the renter pays the total rental fee plus the specified deposit via iDEAL.

3.3 The deposit is accounted for separately from revenue and serves solely as security for the timely, complete return of the equipment.

3.4 Following return and inspection for completeness and proper operation, ToolThuis initiates the eligible deposit refund. The payment provider determines when it reaches your account.

3.5 In case of missing parts or culpable damage beyond normal wear and tear, only actual reasonable repair or replacement costs are deducted from the deposit. Any remaining refund is started after the assessment.

4.1 Renter declares to be at least 18 years of age when entering into the rental contract.

4.2 Upon collection in Purmerend, ToolThuis may ask for valid government photo ID (passport, national ID, or driver’s license) for visual verification. ToolThuis does not retain or store full copies of identification documents.

4.3 For delivery orders, ToolThuis delivers to the specified address within the region. The renter or an authorized adult must be present to receive the equipment.

4.4 Condition and components are jointly verified upon handover.

5.1 Renter agrees to operate the equipment solely for its intended purpose and in accordance with manufacturer safety instructions and manuals.

5.2 Renter is responsible for wearing recommended personal protective equipment (PPE), including safety glasses, hearing protection, dust masks, and safety footwear.

5.3 Before wall chasing, drilling, or demolition, renter must check walls and floors for buried utilities (electrical wiring, gas, and water pipes). For earth drilling, renter must conduct a timely utility check (KLIC check).

5.4 Tools requiring dust extraction (such as wall chasers and drywall sanders) must be used exclusively with a suitable, operational M-class extractor.

5.5 Using equipment on asbestos-containing materials, chemical or toxic waste, or other hazardous materials is strictly prohibited.

6.1 Normal, minor wear from proper DIY usage is part of renting equipment and is never charged to the customer.

6.2 In case of loss, theft, or damage resulting from intent, gross negligence, or improper use violating safety guidelines, the renter is liable for actual incurred loss.

6.3 Damage is documented transparently with photos and itemized repair quotes prior to any deposit deduction.

7.1 Stop using the machine immediately if it produces unusual noises, abnormal vibrations, overheating, or defects.

7.2 Contact ToolThuis immediately by telephone or email. Renters must not attempt repairs or open machine housings.

7.3 If a fault is not caused by improper operation by the renter, ToolThuis provides a replacement unit if available, or issues a proportional refund for unused rental time.

8.1 Equipment must be returned clean and complete by the agreed deadline in accordance with the rental confirmation: for 1-day rentals, maximum 24 hours from the actual agreed handover/start time; for multi-day rentals (2–6 days), the number of paid rental days × 24 hours from handover; for weekly rentals, maximum 7 × 24 hours from handover; and for weekend rentals, from Friday 12:00 until Monday no later than 12:00.

8.2 If unexpected circumstances prevent timely return, notify ToolThuis as early as possible before the rental period expires.

9.1 A consumer entering into a distance rental contract has the statutory right to cancel the contract within 14 calendar days from the date of contract conclusion without stating reasons.

9.2 Following an express request for early performance, withdrawal may require a proportionate payment for the service actually provided up to withdrawal compared with full performance of the agreement (article 6:230s(4) Dutch Civil Code). Calculation uses the agreed total price; if excessive, the market value of the service provided applies. No service costs are payable without the legally required withdrawal and cost information or without the express early-performance request (article 6:230s(5)). The refundable deposit is not payment for the service. ToolThuis assesses the facts and statutory conditions individually; scheduled rental dates do not automatically cause a deduction.

9.3 The right of withdrawal ends after full performance during the withdrawal period only if the consumer gave prior express consent to that performance and acknowledged losing the right after full performance. Starting the rental or reaching the scheduled end date alone is insufficient.

9.4 You can withdraw or cancel without an account via /en/cancel-rental or by email. The model form below is available but optional: any clear withdrawal statement is sufficient. On withdrawal we make the refund due within 14 days of receiving the statement, using the same payment method unless otherwise agreed, without refund fees. Any legally due proportionate fee and separately substantiated damage claim are explained separately.

10.1 Nothing in these terms limits or excludes the liability of ToolThuis to the extent not permitted under mandatory Dutch consumer protection law.

10.2 Liability and any compensation are assessed under the applicable statutory rules. The safety acknowledgement does not limit mandatory consumer rights.

10.3 All legal relationships between ToolThuis and the renter are governed exclusively by the laws of the Netherlands. Disputes may be submitted to the court competent under applicable law. Mandatory consumer rights remain applicable.
